Welcome to OvenPal. These Terms of Use (“Terms”) govern your access to and use of our website, services, and related content. By visiting our site or booking appliance services, you agree to comply with these Terms. If you do not agree, please discontinue use immediately.

2. Scope of Services

We provide appliance cleaning, repair, and maintenance services. Service details, scheduling, and pricing are communicated prior to work. We reserve the right to modify, suspend, or discontinue services at any time without prior notice.

3. Personal Information

We collect limited personal information necessary to provide services, including:

  • Name
  • Email address
  • Phone number
  • Physical address
  • Access details to your home (if relevant for service entry)
  • Images you provide or that we capture when servicing your appliances

All personal information is handled in accordance with our Privacy Policy.

4. Usage Restrictions

You agree not to:

  • Copy, distribute, or transmit any content without prior written consent.
  • Use automated tools (robots, spiders, scrapers) to access or monitor the site.
  • Attempt unauthorized access, probe vulnerabilities, or interfere with site functionality.
  • Use the site for unlawful purposes or to promote illegal activity.

We reserve the right to block or restrict access if these restrictions are violated.

5. Home Access

If service requires entry into your home, you agree to provide safe and reasonable access. We are not responsible for delays or inability to perform services due to restricted access.

6. Appliance Assessment Overview

All service requests begin with a dedicated appliance diagnostic. This appointment allows us to thoroughly evaluate the appliance, understand its condition, and determine the most effective restorative approach for your specific needs. During the visit, we review your goals in detail, answer any questions, and outline the recommended cleaning strategy to ensure the results are both accurate and genuinely beneficial. This initial step enables us to tailor the service precisely to your appliance and expectations, and it also ensures that any limitations, risks, or potential replacement needs are identified before scheduling the full cleaning.

7. Off‑Site Cleaning & Extended Restoration Timelines

Certain components may require specialized off‑site cleaning to ensure they are restored safely and effectively. Items such as heavily carbonized cast‑iron parts, removable interior panels, or components with deep‑set buildup often demand controlled stripping, or treatment processes that cannot be performed inside the home. In some cases, achieving a complete restoration may require a full day or more, depending on the condition of the appliance and the complexity of the work. When off‑site cleaning is recommended, we will outline the process clearly, provide guidance on expected timelines, and ensure all components are handled with the highest level of care throughout the restoration.

8. Appliance Condition & Restoration Limitations

Our restorative cleaning is designed to elevate the appearance, hygiene, and performance of your appliance; however, results will naturally vary based on age, prior use, material composition, and existing wear. Appliances may not appear ‘brand new’ after cleaning, and certain cosmetic imperfections—such as scratches, discoloration, heat staining, pitting, corrosion, or finish deterioration—cannot be fully removed. Components that are worn, warped, rusted, corroded, or structurally compromised will not be restorable through cleaning alone and could require replacement to achieve optimal function or appearance. In many cases, the need for replacement only becomes evident once the appliance has been fully disassembled, cleaned, and evaluated, at which point we will advise you accordingly. To preserve the integrity of delicate surfaces, certain materials—such as aluminum components or other easily marred finishes—may be excluded from deep cleaning to prevent damage. Additionally, the broiler area and surrounding upper interior surfaces are treated with a controlled, light‑touch approach due to their sensitivity and exposure to high heat. We will always inform you when a part is beyond restoration and may recommend appropriate replacement options when necessary.

9. Service Exclusions & Safety Restrictions

To ensure the safe operation of your appliance and prevent damage to sensitive internal components, certain areas are fully excluded from our cleaning services. These exclusions include burner gas pipes, electrical wiring, burner housings, the area beneath surface burners, and any components located beneath the burner grease pans, except for the removable burner caps and rings. Cleaning beneath grease pans is only performed when explicitly requested and confirmed as safe and feasible during the appliance assessment. These components are delicate, safety‑critical, and may be prone to corrosion, displacement, or malfunction if subjected to any level of cleaning.

Additionally, the interior section located directly beneath the oven’s top panel and surrounding the broiler assembly is not cleaned, with the sole exception of the visible broiler‑adjacent area, which receives a minimal, light‑touch cleaning strictly to avoid damage. No deep cleaning, disassembly, or restoration of any internal burner components, gas lines, wiring, housings, or broiler‑adjacent structures is included in our service.

These limitations are in place to protect your appliance from avoidable damage and to maintain compliance with manufacturer safety guidelines.

10. Images

Images taken during service are used only for documentation, training, and quality assurance. They will not be shared publicly without your consent. You grant us a limited license to use such images internally for service improvement.

11. Links to Third‑Party Sites

Our website may contain links to third‑party websites. These are provided for convenience only. We do not control or endorse third‑party sites and are not responsible for their content or practices. Accessing such sites is at your own risk.

12. Accounts and Security

Certain features may require account creation. You are responsible for maintaining the confidentiality of your login details and for all activities under your account. Notify us immediately of any unauthorized use. We disclaim liability for losses arising from your failure to safeguard credentials.

13. Payments and Billing

Payment terms are communicated at booking. Unless otherwise agreed, payment is due upon completion of services. We reserve the right to refuse service if payment obligations are not met.

14. Intellectual Property

The OvenPal® name, logo, and related marks are trademarks of OvenPal or its affiliates. All website content, including text, graphics, logos, and images, is protected by copyright and intellectual property laws. Unauthorized use is strictly prohibited.

15. International Use

Given the global reach of the Internet, you agree to comply with all applicable local laws and regulations, including those governing data protection, privacy, copyright, and trademark rights.

16. No Warranty

Our website, services, and all related content are provided on an “as is” and “as available” basis.

  • We make no representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non‑infringement.
  • We do not guarantee that services will be uninterrupted, secure, error‑free, or free of viruses or other harmful components.
  • You acknowledge that your use of our website and services is at your sole risk.
  • Some jurisdictions do not allow the exclusion of certain implied warranties; in such cases, portions of this disclaimer may not apply.

17. Limitations of Liability

To the fullest extent permitted by law:

  • OvenPal, its parent company, affiliates, officers, directors, agents, employees, contractors, and representatives shall not be liable for any damages of any kind arising out of or in connection with your use of our website or services.
  • This includes, without limitation, direct, indirect, incidental, consequential, punitive, or exemplary damages, even if we have been advised of the possibility of such damages.
  • We are not liable for pre‑existing damage to appliances or property, nor for losses arising from misuse, neglect, or improper installation.
  • Our total liability to you for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
  • Certain jurisdictions may limit liability exclusions; in such cases, our liability is limited to the maximum extent permitted by law.

18. Cancellations and Rescheduling

Cancellations or rescheduling may be permitted with 48 hours’ notice. Because each appointment reserves dedicated technician time and prevents us from accommodating another client, late cancellations will incur a fee equal to 50% of the quoted service price. To maintain scheduling reliability, repeated cancellations may result in refusal of future service.

19. Indemnification

You agree to indemnify, defend, and hold harmless OvenPal, its parent company, affiliates, officers, directors, agents, employees, contractors, licensors, and suppliers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of:

  • Your violation of these Terms.
  • Your misuse of our website or services.
  • Any breach of representations or warranties you provide.
  • Any claim related to images, content, or information you submit to us.

This obligation survives termination of your use of our services.

20. Violations of the Terms

We reserve the right, at our sole discretion and without prior notice, to:

  • Suspend or terminate your access to our website or services if we determine you have violated these Terms, applicable laws, or related policies.
  • Seek injunctive or equitable relief in addition to any other remedies available at law or equity.
  • Terminate your account for other reasons, including law enforcement requests, discontinuation of services, or technical issues.

Violations may be deemed unlawful and unfair business practices, causing irreparable harm for which monetary damages may be insufficient.

21. Resolution of Disputes

We are committed to resolving disputes efficiently and fairly.

  • Many customer concerns can be resolved informally by contacting our support team.
  • If a dispute cannot be resolved informally, the following binding arbitration terms apply.

22. Arbitration Procedures

  • Agreement to Arbitrate: Any dispute, controversy, or claim arising out of or relating to these Terms or our services shall be resolved by binding arbitration, rather than in court.
  • Scope: This includes claims based on contract, tort, statute, fraud, misrepresentation, or any other legal theory.
  • Rules: Arbitration shall be conducted under the rules of the American Arbitration Association (AAA), including its Consumer Arbitration Rules.
  • Location: Arbitration shall take place in New York State, unless both parties agree otherwise.
  • Costs: For non‑frivolous claims under $10,000, OvenPal will cover arbitration costs and allow proceedings by telephone if preferred.
  • Finality: The arbitrator’s decision shall be final and binding, and judgment may be entered in any court with jurisdiction.
  • Exception: Claims seeking injunctive relief or enforcement of intellectual property rights may be brought in court.

23. Class Action Waiver

By using our services, you agree that:

  • All disputes must be resolved on an individual basis.
  • Neither you nor OvenPal may bring claims as part of a class action, collective action, or representative proceeding.
  • The arbitrator has no authority to consolidate claims or grant relief on behalf of others.
  • You waive the right to participate in any class or representative action against OvenPal.

24. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. The Federal Arbitration Act governs the interpretation and enforcement of the arbitration provisions.

25. Additional Terms

Failure to enforce any provision does not waive our rights. If any provision is invalid, the remainder remains enforceable. We may assign our rights and obligations under these Terms without notice.

26. Entire Agreement

These Terms represent the complete agreement between you and OvenPal regarding use of our website and services. They supersede prior communications or agreements.
